Does a New York truck need a USDOT number for in-state work?

Yes. New York requires a USDOT number for in-state commercial vehicles at 10,001 lb and over (GVWR or GCWR, or the actual weight if greater), even if they never cross a state line.

Checked against New York’s official sources in September 2026.

The rule in New York

Who it covers: Anyone operating a truck for business purposes, for-hire or private, at 10,001 lb GVWR/GCWR or more, whether intrastate or interstate.

The weight line: Any truck used for business with a GVWR, or a truck and trailer with a GCWR, of 10,001 lb or more needs a USDOT number in New York, even if it never leaves the state. Trucks used only for personal or recreational purposes do not.

Exemptions the state lists:

  • Trucks used strictly for personal (non-business) or recreational use
  • Licensed NYS DMV inspection/repair facilities and dealers road-testing a customer's empty commercial vehicle for repairs (17 NYCRR 820.1(e))
  • Hours-of-service rules for intrastate commerce do not apply to certain farmer-owned vehicles hauling farm products, tow trucks answering calls, or utility service vehicles (17 NYCRR 820.6(b))
“Regulations require you to display a USDOT number whether you operate wholly within New York (intrastate) or across state lines (interstate).” source
“If you operate a truck for business purposes with a gross vehicle weight rating (GVWR) or a truck and trailer with a gross combination vehicle weight rating (GCWR) of 10,001 lbs. or more, you need a USDOT number.” source

The rule: 17 NYCRR 820.1 (adopts 49 CFR Part 390, including USDOT registration and marking, for carriers operating commercial motor vehicles in commerce within New York; 10,001 lb definition)

Who to ask: New York State Department of Transportation, Office of Modal Safety and Security (Truck and Motor Carrier)

  • Intrastate-only drivers of Class B CDL vehicles, and some non-CDL commercial vehicle drivers, may drive at 18.
  • Intrastate drivers of non-CDL commercial vehicles who got their first driver's license before January 1, 2004 are not required to hold a medical certificate.

The federal lines, which apply in New York too

  • 10,001 lb and interstate commerce: a USDOT number, a medical card, a driver qualification file, the hours-of-service rules and daily inspections (49 CFR 390.5).
  • 26,001 lb: a CDL, for a single vehicle or a combination towing more than 10,000 lb (383.5). The CDL rules cover in-state driving as well (383.3), and drug and alcohol testing follows the CDL (382.103).
