Does a West Virginia truck need a USDOT number for in-state work?

Yes. West Virginia requires a USDOT number on any commercial vehicle rated 10,001 lb or more, and on every vehicle operated for hire, whatever it weighs.

Checked against West Virginia’s official sources in September 2026.

The rule in West Virginia

Who it covers: Both for-hire motor carriers (every for-hire vehicle, any weight) and private commercial carriers (vehicles of 10,001 lb GVWR or more), intrastate and interstate.

The weight line: A USDOT number is required on any commercial-purpose vehicle rated 10,001 lb or more, and on every vehicle operated for hire regardless of weight, plus 16+ passenger vehicles and placarded hazmat.

Exemptions the state lists:

  • The requirement does not apply to companies that do not own or operate any vehicles over which USDOT has safety jurisdiction (150CSR9 § 4.13.1)
  • Carriers completely exempt from regulation under W. Va. Code § 24A-1-3 or other law are outside the rule's scope (150CSR9 § 1.1)
“Every motor carrier and every private commercial carrier shall, where applicable, obtain and, while operating in intrastate or interstate commerce in West Virginia, shall conspicuously display on each (a) motor vehicle operated for hire; (b) motor vehicle, operated for any commercial purpose with a gross vehicle rating of ten thousand one (10,001) pounds or more” source
“motor vehicle, operated for any commercial purpose with a gross vehicle rating of ten thousand one (10,001) pounds or more” source

The rule: W. Va. Code R. § 150-9-4.13 (150CSR9, Rule 4.13); W. Va. Code § 24A-1-2 (private commercial carrier definition)

Who to ask: Public Service Commission of West Virginia, Transportation Enforcement / Motor Carrier Section

Safety rules for in-state trucks

Motor carriers and private commercial carriers, intrastate or interstate, must follow 49 CFR Parts 107, 171-180, 325, 350, 382, 383, 385-399; every commercial vehicle (10,001 lb+) and every for-hire vehicle of any capacity must comply. (W. Va. Code R. § 150-9-4.3)

  • For-hire vehicles must follow the federal safety rules at any size, not just from 10,001 lb.
  • The planting and harvesting season for hours-of-service farm exemptions runs all year.

The federal lines, which apply in West Virginia too

  • 10,001 lb and interstate commerce: a USDOT number, a medical card, a driver qualification file, the hours-of-service rules and daily inspections (49 CFR 390.5).
  • 26,001 lb: a CDL, for a single vehicle or a combination towing more than 10,000 lb (383.5). The CDL rules cover in-state driving as well (383.3), and drug and alcohol testing follows the CDL (382.103).
